Terms of service
Effective: 6 October 2026
What changed: who at Design Industries can see your content, and when.
1. Agreement
These terms govern your use of Diya (diya.au), an AI assistant operated by Design Industries Pty Ltd (ABN 98 111 471 179) ("Design Industries", "we", "us"). By using Diya you agree to these terms and to our privacy policy.
2. The service
Diya is an AI assistant built on Anthropic's Claude models. It can work with other services you connect, such as Jira, Confluence and Slack. Which features and models you can use, and your daily limits, depend on your account. We may change or discontinue features at any time.
3. Accounts
You must provide accurate account information and keep your sign-in method secure. You are responsible for activity under your account. We may suspend accounts that breach these terms or pose a security risk.
4. Acceptable use
You agree not to:
- use Diya for unlawful purposes or to generate harmful, infringing, or deceptive content;
- attempt to circumvent usage limits, authentication, or security controls;
- probe, scrape, overload, or disrupt the service or other users;
- reverse engineer the service except as permitted by law.
Investigating a suspected breach of these terms, or a security risk, can involve looking at content under the rules in our privacy policy (section 3).
5. AI-generated content
Diya's replies are generated by AI and may be inaccurate, incomplete, or out of date. They do not constitute professional, legal, or financial advice. You are responsible for reviewing and verifying outputs before relying on them or sharing them.
6. Your content and connections
You retain ownership of the content you submit and the outputs generated from it. You grant us the licence needed to operate the service (storing, processing and transmitting your content as you direct, and as our privacy policy describes in section 3). When you connect another service, you authorise Diya to act on your behalf within that service; your use of that service remains governed by its own terms.
7. Intellectual property
The Diya platform, brand, and underlying software are owned by Design Industries Pty Ltd or its licensors. These terms do not grant you any rights in them other than the right to use the service.
8. Availability
Diya is provided on an "as available" basis without an uptime commitment. We may interrupt access for maintenance or security reasons.
9. Liability
Nothing in these terms excludes rights you hold under the Australian Consumer Law or other law that cannot be excluded. To the extent permitted by law, Design Industries' total liability arising out of the service is limited to the amount you paid for it in the previous 12 months (or AU$100 if you have paid nothing), and we are not liable for indirect or consequential loss, or for loss arising from reliance on AI-generated content.
10. Termination
You may stop using Diya at any time and request deletion of your data. We may suspend or terminate access for breach of these terms, with notice where practicable.
11. Governing law
These terms are governed by the laws of Victoria, Australia, and the parties submit to the non-exclusive jurisdiction of its courts.
